These Terms govern your use of the website at massillonlegal.com and the document preparation, e-signing, and Remote Online Notary services provided by Massillon Legal Support and Notary Services (“we,” “us,” or “Massillon Legal”), a Florida sole proprietorship operated by Phillippe Massillon Simon.

1. Acceptance

By creating an account, submitting an intake, or using any of our services, you agree to these Terms. If you do not agree, do not use the site or services.

2. Nature of services — important

Massillon Legal is not a law firm. Phillippe Massillon Simon is not licensed to practice law in Florida or elsewhere. We do not, and will not:

  • Provide legal advice or legal opinions
  • Recommend a course of action or legal strategy
  • Choose forms or arguments for you
  • Represent you in any matter or court
  • Hold attorney-client privilege with you

We provide self-help document preparation, document organization, e-filing assistance, e-signing tooling, and Remote Online Notarization, performed strictly to your written instructions. Phillippe is a Florida-commissioned notary public; notarial acts are performed in his capacity as a notary, not as an attorney.

3. Accounts

You're responsible for the accuracy of the information you provide and for keeping your password secure. You must be at least 18 years old. You may not share credentials. Notify us immediately of any unauthorized access at security@massillonlegal.com.

4. Fees, deposits, and refunds

We quote a flat fee or deposit-plus-balance amount before work begins. Payments are processed by Stripe; we do not store your card information. Deposits are non-refundable once we've started preparing your documents. Balances are due upon delivery. Refund requests for completed work will be considered on a case-by-case basis.

5. Remote Online Notary (Florida)

Remote Online Notarization is performed under the Florida Online Notary Act (Fla. Stat. § 117.201 et seq.). The notary is required to be physically located in Florida during the session; the signer may be anywhere in the United States. Sessions are conducted through OneNotary or SnapDocs, both Florida-approved RON platforms. Identity verification is performed by the platform via knowledge-based authentication and credential analysis. The notarial journal entry and the audio/video recording are retained for 10 years.

6. E-signatures

When you electronically sign a document through our platform, you consent to do business electronically and acknowledge that your electronic signature has the same legal effect as a handwritten signature under the U.S. E-SIGN Act and Florida's Uniform Electronic Transaction Act. We retain your IP address, user agent, timestamp, and signature image as the audit record.

7. Confidentiality

We treat the documents and information you share with us as confidential. We disclose them only as required to deliver the requested services (e.g., to the e-filing portal at your direction, to the RON provider for a session you scheduled), or as required by law.

8. Acceptable use

You agree not to:

  • Submit forged, falsified, or fraudulent documents
  • Impersonate any person or misrepresent your identity
  • Use our services to commit or facilitate a crime, including fraud, forgery, or unauthorized practice of law
  • Reverse engineer, scrape, or otherwise interfere with the platform
  • Upload material you don't have the right to share

We may suspend or terminate accounts that violate these rules and report to authorities when required.

9. Intellectual property

You retain ownership of the documents you upload. By uploading, you grant us a limited license to store, process, and transmit them solely to deliver your requested services. Our website, code, content, and brand are owned by Massillon Legal.

10. No guarantees

We don't guarantee a particular legal outcome. Court rules, judges, and circumstances vary. We perform the work to your instructions; we don't evaluate whether your instructions are legally sound — that's your responsibility (or that of your attorney).

11. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim arising out of these Terms or the services is limited to the amount you paid us for the specific service giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or lost data, even if we've been advised of the possibility.

12. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your violation of these Terms, your misuse of the services, or your violation of any law or third-party right.

13. Termination

You may close your account at any time by emailing hello@massillonlegal.com. We may terminate or suspend your account for breach of these Terms, non-payment, fraud, or to comply with law. Sections that by their nature should survive termination (3, 7-12) survive.

14. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Disputes arising out of these Terms or the services will be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to that jurisdiction.

15. Changes

We may update these Terms. Material changes will be emailed to registered users. Continued use after changes constitutes acceptance.
